Visitor visa without permission to carry out paid activities, requested from the Institute for humanitarian reasons

Case in which it occurs:

Applicable to the natural person, or to the dependency of the Federal, State or Municipal Public Administration, that requests a visa for humanitarian reasons for a foreign person who is in the assumptions provided in this procedure.

Legal basis:

Article 1, 3, sections I, VI, XI, XIII, XIX, XXIX and XXX, 21, section IV, 37, section I, subsection b), 39, 41, 43, 52, section V, 77, 79, 126 , 127, 128, 130 and 131 of the Law, and 1, 2, 116 and 117 of the Regulation.

Form of presentation:

Format to request visa authorization from the Institute.

Place where it is presented:

Institute processing offices.

Amount of fees:

DOES NOT APPLY.

Maximum resolution period:

20 business days.

Validity of the authorization:

30 business days from the day after the petitioner is notified of the origin of the consular interview.

Exceptions to article 15-A of the Federal Law of Administrative Procedure:

Those indicated in section III subsection a, numeral 1 of the requirements section.

Requirements:

I. Original of the responsive letter by the petitioner, assuming the travel and permanence expenses generated by the foreign person's stay in the country;     

II. Legible copy of the passport or identity and travel document that is valid in accordance with international and current law of the foreign person for whom a visa is requested;    

III. That the foreign person for whom the visa is required does not have an application for a visitor visa without permission to carry out paid activities, requested from the Institute for humanitarian reasons pending resolution, and    

IV. Present the documents that prove any of the following assumptions:   

to. Family bond that is not considered within the assumptions of family unity:    

1. Original and copy of a valid official identification of the promoter;    

2. Original of the birth or marriage certificates that prove kinship;    

3. Free writing with autograph signature of the petitioner stating that his family member is a victim of a natural catastrophe or is in a situation of danger to his life or integrity due to violence or natural disaster. The resolution must consider what is stated in subsection a. of the resolution section of this procedure, and    

4. Original of the certificate or medical record on letterhead, issued by a public health institution, stating the serious health status of the applicant, who is requesting a visa for his / her family member in order to provide assistance.    

b. Public interest:    

       Original of the letter on letterhead, signed by the competent authority of any dependency of the Federal, State or Municipal Public Administration, in which it expressly cites the legal provisions and precepts that empower the subscriber to carry out the management, and expose the activities or specific functions in time, manner and place to be carried out by the foreign person according to what is indicated in subsection b. of the section on criteria for resolution of this procedure.

 

 

Resolution criteria:

- The application for visa authorization for humanitarian reasons can be submitted by any of the following people:      

to. For a Mexican or foreign person temporarily or permanently residing in the country, requesting a visa for humanitarian reasons for a foreign person with whom he or she proves family ties, as long as:    

i. The bond is not considered within the assumptions of family unity, and     

ii. Prove that the foreign person for whom you require a visa is a victim of a natural catastrophe, or     

iii. Prove that the foreign person for whom you require a visa is in a situation of danger to her life or integrity due to violence or natural disaster, or    

iv. Require assistance from the family member for whom you are applying for a visa, due to being in serious health.    

- In the case of a foreign person who requests a visa for being located in the event of being a victim of a natural catastrophe, or for being in a situation of danger to his life or integrity due to violence or natural disaster, the immigration authority will obtain the means of proof that deems appropriate to better provide.      

- For the same purpose, the migration authority may contact UNHCR in the event that there are guidelines or considerations of international protection with respect to a specific country.      

b. Due to dependency of the Federal, State or Municipal Public Administration that requests a visa for humanitarian reasons for a foreign person who intends to carry out relief or rescue actions in emergency or disaster situations in the country and is a member of any group of public, private or that have that purpose.    

       The foregoing as long as the activities or services provided are temporary and are not remunerated.

- The immigration authority will gather the means of proof that it deems convenient to better provide.      

- The immigration authority will deny the immigration procedures of people who are located in the assumptions of article 43 of the Law.      

- The consular office, where appropriate, will issue the visitor visa without permission to carry out paid activities.      

Important information for the user:

- The authorization issued by the Institute will be valid for 30 business days from the date it is granted. At the end of that term, the authorization loses effect and you will not be able to continue with the process.      

- At the time the issuance of the visa is authorized for humanitarian reasons, both the applicant and the foreigner will be informed of the right of the second to request refugee status upon entering the national territory.
