REGULATIONS FOR MINORS (UNDER THE AGE OF 18) OR PEOPLE UNDER LEGAL GUARDIANSHIP TRAVELLING ALONE OR WITH A NON PARENTAL ADULT OR LEGAL GUARDIAN OUTSIDE MEXICAN TERRITORY
From January 2nd 2014, new regulations concerning the modification of articles 42, 53 and 247 of the Mexican Migration Law, relating to children under the age of 18 or people under legal guardianship travelling outside Mexican territory, entered into force.
Nota bene:
- These regulations do not apply to children (or people under legal guardianship) if THEY travel accompanied by any parent (mother or father) or legal guardian.
- THE NEW REGULATIONS APPLY EXCLUSIVELY TO MEXICAN AND FOREIGN NATIONALS RESIDING IN MEXICO (PERMANENT RESIDENT, TEMPORARY RESIDENT AND TEMPORARY RESIDENT STUDENT) WHO TRAVEL OUTSIDE THE COUNTRY ALONE OR ACCOMPANIED BY AN ADULT WHO IS NOT A PARENT OR LEGAL GUARDIAN.
Children (and people under legal guardianship) will only be able to travel outside Mexico, alone or accompanied by an adult, different to any of their parents, when presenting one of the following documents:
- Notarized permission to leave the country by either parent or legal guardian. The notarized permission should be granted by a Notary Public or Solicitor, apostilled and translated into Spanish. This document should specify the means of transportation (Airline company), country of destination and travel date.
The notarized permission must be granted before a Solicitor or Notary Public, apostilled by the Foreign and Commonwealth Office (FCO) and translated into Spanish.

- Authorization Form for Travelling outside Mexico.
Parents or Legal Guardians of children, Mexican and Foreign Nationals with Mexican residency, should visit the website www.inm.gob.mx and complete the online authorization form.
The Authorization Form should be printed three times and each one must be accompanied by the following documents:
- Copy of the child’s or person under legal guardianship’s passport.
- Copy of the child’s or person under legal guardianship’s birth certificate.
- Copy of the passport of the parent (mother or father) or of the legal guardian.
This form should be presented to the migration officer at the departure point (Airport or Port of exit). The officer will stamp the form and their exit will be permitted. A copy of the form should also be presented to the airline or company while checking in.
The Authorization form will be valid for 180 days from its online registration and will only be valid for one trip.
EXCEPTION
Children and people under legal guardianship are exempted to present the notarized permission or the authorization form for travelling outside Mexico only in the following cases:
- Mexican or foreign nationals who travel accompanied by a parent or their legal guardian.
- Mexican nationals who travel alone in order to be repatriated to National territory.
