Agreement for the Exercise of Parental Authority by Third Parties for Minors and Incapacitated Persons
This document is granted by the parents of a minor or incapacitated person to formalize the terms under which they will exercise parental authority. This document is commonly granted when the parents, for any reason, establish their residence in a different location (either nationally or internationally) and leave their minor children under the care of a trusted family member or individual in the national territory or abroad, who will temporarily exercise this right.
The authorizations granted by the individuals exercising parental authority or guardianship over minors or incapacitated persons can be given to allow the minor to leave the parental home, make decisions regarding their education, manage their own assets, or consent to marriage.
Parents cannot prevent the personal relationships of the minor with their relatives without just cause. The parents must exercise parental authority jointly, and if they separate, they must agree on this matter. If there is no agreement, the Family Judge will decide.
The agreement between the parents does not imply the renunciation of parental authority in any way.
REQUIREMENTS:
- Fill out the application form.
- Valid passport(s) of the person(s) exercising parental authority, or if unavailable, valid official identification with a photograph (such as voter ID, consular registration card, or military service card).
- Document(s) proving the parental authority or guardianship over the minor or incapacitated person (birth certificate or court resolution).
- Payment of consular fees.
PROCEDURE:

Once the documentation is received and verified, the Consulate General will contact you to schedule a date and time for signing the deed.
On the day of the appointment, proceed as follows:
- Appearance of the person(s) authorized to grant the agreement.
- Presentation of all original documents.
- Payment of the applicable fees via transfer. See consular service fees.
